The following liability disclaimer applies to events hosted by us, Best Events Productions Sdn Bhd (BEP), our representatives, agents, sponsors, and employees and to the BEP and Horizon Art Fair websites.

In the unlikely occurrence that a BEP event must be cancelled or postponed due to circumstances beyond the control of BEP, we shall not be liable for any costs incurred by the event partner, supporting partner, sponsor, artist or event attendee prior to the planned event.

Event Cancellation. BEP, the sponsoring/hosting organization, and/or co-sponsoring organization(s), in their sole individual discretion, reserve the right to cancel or postpone this event at any time without any liability for the fulfillment of this contract and all fees paid by Sponsors/Vendors shall, in the sole discretion of BEP, be either credited to future events or refunded on a prorated basis (less BEP’s direct costs and reasonable overhead expenses). If the event or any part thereof is canceled or postponed for any reason beyond the control of BEP such as, but not limited to, damage or destruction to the venue buildings, war, riots, strikes, fire, floods, weather, pandemic, termination by sponsoring/hosting organization or co-sponsoring organizations(s), acts of government, terrorism, or acts of God, or the breach or termination of the venue contract, then BEP is not obligated to refund any fees. In any such case, credits from event postponement or cancellation must be used within 12 months of the original postponement/cancellation dates. After 12 months a credit on account will be considered earned by BEP and non-refundable.

BEP does not accept responsibility and expressly excludes liability to the fullest extent permitted by law for the following:

• any loss or damage to any personal property left unattended during an event organized by BEP unless caused by the negligence of BEP or its employees; or
• death or any personal injury suffered at a BEP event unless caused by the negligence of BEP or its employees.

BEP does not assume any responsibility or obligation to provide financial or other assistance, including, but not limited to medical, health, or disability insurance in the event of injury, illness, death, or property damage occurring during an event or travel to and from an event.

BEP will record images and sound at its events. By virtue of attendance, attendees agree to BEP’s usage of these recordings on our website and for marketing.

Despite the great care taken to prepare and update this website, BEP disclaims all warranties with regard to information posted on this website. Readers will make their own determination of how suitable the information is for their usage and intent. In no event will we be responsible for damages resulting from the use or reliance upon this information. We are not responsible for opinions and information posted by others on this website. The inclusion of links to other sites does not necessarily imply a recommendation or endorse the views expressed within them.
